Comment (5/2003): Correction - The Delaware Department of Transportation posts the speed limits along state highways and roads in Delaware (Bethany Beach, South Bethany and Fenwick Island included). The majority of the area along State Route 1 (Ocean Highway or Coastal Highway) is residential and commercial - not open highway. There are a large number of pedestrians and slower moving traffic in the area. Towns DO NOT determine the posted limit on state-maintained roadways. It is generally left to officer discretion regarding traffic enforcement (including speed violations). My department allows officers to REDUCE speeding tickets to 9 miles per hour over the posted limit. In other words, if I stop you for traveling 60 in a 35 MPH zone, I can reduce your ticket to 44 in a 35 MPH zone. Considering that your fine was cut considerably, and points were reduced from 5 to 2, I think that is certainly a benefit to the offender. It is important to note that officers in the Bethany Beach/South Bethany are are now concentrating on more serious traffic offenses, such as license and registration violations. Every cruiser is equipped with a mobile computer and officers check tags routinely. Many stops lead to even more serious offenses such as drugs and weapons offenses. I can personally attest that of the 500+ traffic tickets I wrote in the last two years, only about 40 were for speeding violations.
