Actually, have a question since it's been almost 30 years since I lived in NJ; but now am retired from the military, reside in the South, and make the annual trip up north to see relatives and friends - here goes: Can a cop from a different municipality, traveling in a marked car and in uniform from that municipality, pull you over and cite you for a traffic infraction even though his so-called jurisdiction is someplace else. Example: Edgewater Park Township cop pull you and cite you for a traffic infraction over in Mt. Holly? If this can happen, why on earth do all the individual townships have their own police department? Why not do like some norhern NJ counties and have a county police and do away with the individual munipal PDs? One uniform, one chain-of-command, on color of patrol cruiser, responsible to county government. Anyone know?? | |

Comment (6/2005): South of Minot there is not "Burlington" on Hwy 83. The very next town is Max ND. If you go west on Hwy 2/52, there is a Burlington ND. To answer your question about jurisdiction. The state of North Dakota has a law that city police (municipalities) may go 1.5 miles outside the city limites to enforce laws (criminal/traffic). Those summons may be written into the city court, providing they are not a felony. If a felony occurs, then it must be written into District Court. There are a few exceptions to this basic rule. IF YOU DON'T LIKE GETTING STOPPED, then I suggest you do the speed limit and obey the rules of the road. Burlington is not the only municipalities that expands its borders in North Dakota. There are numerous others. We want your business in our jurisdiction, however, the safety of our citizens it the utmost priority of the Burlington Police Department. | |
