Police set up north of this little town on an open road stretch of Hiway 411 where the speed limit is allegedly 40 mph, although, I completely missed any signs indicating that to be the case. A considerable distance ahead, I saw a vehicle which I suspected was a police car parked just off the road. I checked my speed and was going slightly over 50 mph. I felt this to be well within legal, as well as reasonable, limits so did not attempt to adjust downward. When I passed his position, he could clearly see my out of state tag. Now I have no evidence or information that he took that into consideration when deciding what to do. I do, however, have and opinion. He promply pulled out into the road behind me, pulled me over and ticketed me for allegedly going 60 mph in a 40 mph zone. He instructed me to send a check for $84.50 to the Benton Police Dept. or personally appear in court by a date certain or face additional fines. I plan to send a check. Being an out-of-stater, I don't have a snowballs chance in hades of prevailing even though right and truth are on my side. I have over time known of these types of traps in many small towns throughout the south. But this is my first time to be personally victimized. The modus operandi is nearly always the same. Take a nice stretch of open road that any rational person would think of as having a normal 55mph speed limit, sneak in an unrealisticly low speed limit, place it under police surviellance, and ticket out of area drivers who are otherwise driving carefully, safely, and behaving normally. All perfectly legal. So be careful out there. These kinds of places have long existed and will no doubt continue to exist long into the future. The states seemingly have no stomach for cleaning them up and in some cases even share complicity.

Comment (9/2002): I also was victimized in the same spot! I never saw any speed limit signs indicating a lower speed. I had to pay over $100. My cousin lives north of Benton and said that is how that small town gets their revenue is through speed tickets from out of towners. SO BEWARE

Comment (4/2003): I also grew up in polk co. and have heard people talk all my life,but the state of tn. sets the speed limit on state roads not the city they just enforce it.I drove a truck for several years and Benton seems to be as fair as any and more than some places

It not just out of state people, it is also out of county residence. So make sure the next time you stay on the interstate and out of this podunk town. Question why would you drive through this town anyway, you know its bad when the only decent store in the entire county is a gun store called benton shooters.

Comment (8/2003): Driving home to Atlanta from visiting a friend in Mt. Vernon, KY, who I hadn't seen for over 33 years, I was stopped in Benton for speeding. Not a good way to end an otherwise wonderful weekend. Just south of Knoxville I remembered my husband mentioning that Hwy 411 allowed you to by-pass Chattanooga. My husband usually gives me good advice (he is the one that pointed me to this website). The five hour trip took me over an hour longer partly because of the rain, but also because a perfectly good four lane Road (Hwy 411) jumped from one speed limit to another every half mile or so. I know this is probably an exaggeration, but it sure seemed that way. I was crusing right along at 52 when I saw the blue lights behind me. I told the officer who stopped me that I started slowing when I saw the reduced speed sign, but he argued that I had passed 4 other signs that posted the speed limit at 40mph. I was too tired to back track to see if that was the case, but I do know one thing. I will never, ever drive Hwy 411 again in my life. If I would have stayed on the freeway I would have avoided the whole situation. Places like Benton, TN give small town America a bad reputation. At 84.50 a crack, I think I will steer clear of that little speed trap. I think I would rather people think of my town as a place to visit and feel welcomed, not a place to avoid.

They don't just get out of towners, they will also get people they are not acquainted with or just simply don't know. If they know you, you will not get a ticket or be harassed. I even know of a cop in Benton who gave someone there beer back a couple of days after they got arrested for speeding and simple possesion. Go figure. What does that tell ya.

You have to be careful about going downhill as well....watch those cruise controls....going down a hill can cause you to speed up a little and they'll be there waiting to catch you......Especially if you're not from Polk County...The Police are dirty in Benton but once I had a fan belt problem when I was going thru Benton and the Station that I stopped at went out of his way to help me..so there are some good people in Benton.

I don\'t speed. I understand that 25 means 25 and 40 means 40. There have been 40mph signs posted ever 1/4 mile or so from the start to the end of town. Absolute not allegedly. This stretch of road (about 1 1/2 miles) is well marked as 40 with \"Reduced Speed\" signs at both ends. The south end turns into 55 and continues that speed until the 64 intersection. Then you claim you were VICTIMIZED? VICTIMIZED? You are about \"No personal responsibility\" and blame the problems you brought on yourself on someone else. Benton is a notorious speed trap that has flourished for years. It has received less attention in recent years only because I-75 has taken much traffic off US 411, which is the main drag through this little town of about 2,000. I feel sorry for any resident of Benton who actually needs law enforcement assistance, because all the Benton police do is run the speed trap targeting anybody who goes through town on 411 with an out of state tag. The mayor's wife, who is not a lawyer, is the kangaroo court judge. The police are not required to lock in the radar reading and show it to the victim, which leaves them free to make up any number they please when they issue a citation to an out of state victim who is unlikely to waste his time coming back to fight a ticket in a rigged kangaroo court that does nothing but rubber stamp what the police do. The speed limit through town is 35. I was doing 30 and got cited for 51 only because I had Maryland tags on my truck. Tickets are rarely issued to local residents, and the kangaroo court routinely dismisses cases against local residents while anybody who is not a local resident is automatically guilty.

The Benton Police commonly work radar in the parking lot of City Hall. Going north on U. S. 411 leaving town, city hall is on the right. The best landmark is Higgins Funeral Home on the left - city hall is right after this on the right. If you're speeding, you'll be right on top of City Hall before you know it. Coming south on U. S. 411, you won't see City Hall at all until you're almost even with it, and may not see it or the police there at all if you're not familiar with the area until it's too late! If traveling south, the best idea is to obey the speed limit until you go through the one and only traffic light in town.

this is a very small town which uses it's speed enforcement as it's main means of revenue. they will go beyond the city limits too. if you decide to fight the case, court is held in the police dept office with a silent judge presidinge over the proceedings and a police detective doing all the talking making such statements as "you wouldn't have been ticketed if you weren't guilty". this dept preys on out-of-state tourist traveling through the area.

When Traveling on US Hwy 411 in Benton Tenn. the speed limit is 45 mph and that is what it means. It is strictly enforced all the way through, so slow down. Also north of there in Englewood Tenn. same thing.

Comment (1/2003): Several years ago I lived in Benton for 2 years. I noticed right away that the police allowed the locals to drive any way they wanted to without ticketing them. I drove more cautiously than I ever had before because I did not want to be obligated to them.

Comment (9/2002): I also was victimized in the same spot! I never saw any speed limit signs indicating a lower speed. I had to pay over $100. My cousin lives north of Benton and said that is how that small town gets their revenue is through speed tickets from out of towners. SO BEWARE

Comment (4/2003): I was a victim of the Benton speed trap but since I grew up in Polk County, I knew where the bodies were buried. They were glad to get rid of me.

Comment (4/2003): I also grew up in polk co. and have heard people talk all my life,but the state of tn. sets the speed limit on state roads not the city they just enforce it.I drove a truck for several years and Benton seems to be as fair as any and more than some places

Comment (6/2003): I know of a benton police officer that suffered from the hands of his supervisor for writing to many tickets to locals. It not just out of state people, it is also out of county residence. So make sure the next time you stay on the interstate and out of this podunk town. Question why would you drive through this town anyway, you know its bad when the only decent store in the entire county is a gun store called benton shooters.

Comment (8/2003): Driving home to Atlanta from visiting a friend in Mt. Vernon, KY, who I hadn't seen for over 33 years, I was stopped in Benton for speeding. Not a good way to end an otherwise wonderful weekend. Just south of Knoxville I remembered my husband mentioning that Hwy 411 allowed you to by-pass Chattanooga. My husband usually gives me good advice (he is the one that pointed me to this website). The five hour trip took me over an hour longer partly because of the rain, but also because a perfectly good four lane Road (Hwy 411) jumped from one speed limit to another every half mile or so. I know this is probably an exaggeration, but it sure seemed that way. I was crusing right along at 52 when I saw the blue lights behind me. I told the officer who stopped me that I started slowing when I saw the reduced speed sign, but he argued that I had passed 4 other signs that posted the speed limit at 40mph. I was too tired to back track to see if that was the case, but I do know one thing. I will never, ever drive Hwy 411 again in my life. If I would have stayed on the freeway I would have avoided the whole situation. Places like Benton, TN give small town America a bad reputation. At 84.50 a crack, I think I will steer clear of that little speed trap. I think I would rather people think of my town as a place to visit and feel welcomed, not a place to avoid.

Comment (8/2003): The city of Benton is small. Of course the cops have nothing better to do but look for ways to make income for the city. (I believe its more boredom than anything). They don't just get out of towners, they will also get people they are not acquainted with or just simply don't know. If they know you, you will not get a ticket or be harassed. I even know of a cop in Benton who gave someone there beer back a couple of days after they got arrested for speeding and simple possesion. Go figure. What does that tell ya.

Comment (8/2003): Drivers should be aware that the City of Benton recently expanded its limitsabout 1 mile both north and south of town. The city limit of 40 mph now includesthese new areas. Those drivers used to the old 55 mph limit should beware.

Comment (9/2003): It is true Benton is set up, but it is not true that signs are not posted. I drive thru here 5 days a weeks and 40 is posted several places on both ends of town

Comment (9/2003): Everybody I know--including my Father and my Husband has got a ticket in Benton at one time or another.. You have to be careful about going downhill as well....watch those cruise controls....going down a hill can cause you to speed up a little and they'll be there waiting to catch you......Especially if you're not from Polk County...The Police are dirty in Benton but once I had a fan belt problem when I was going thru Benton and the Station that I stopped at went out of his way to help me..so there are some good people in Benton.

Comment (12/2003): Day before Thanksgiving, 2003, stopped and ticketed [$84.50] on 411 north of town. I was out of state. Policeman said I had passed NINE 40mph signs. Did not see one and thought I was out of town. The town must really need the money to present the image that it does to strangers.

Comment (07/2007): As a newcomer to Benton in 2001, with out of state tags, I was never acosted, arrested or ticketed for any alleged speeding offences because, Drum roll please............. I don\'t speed. I understand that 25 means 25 and 40 means 40. There have been 40mph signs posted ever 1/4 mile or so from the start to the end of town. Absolute not allegedly. Since when is slightly over 50mph (or exactly 60mph) well within the legal or reasonable limit of 40mph? This stretch of road (about 1 1/2 miles) is well marked as 40 with \"Reduced Speed\" signs at both ends. The south end turns into 55 and continues that speed until the 64 intersection. The north side also reduces to 45 at the high school entrance about a mile north of town then continues 55mph until Etowah. The 40 mph are is very obviously NOT a \"Stretch of Open Road\". Then you claim you were VICTIMIZED? VICTIMIZED? You are about \"No personal responsibility\" and blame the problems you brought on yourself on someone else. Above anyone else who has posted you earned your ticket with your arrogance.
