NOTE: Radar use by City Police Departments is prohibited by WV State law for towns the size of Clendenin. Without radar, the City Police Officer has no concrete proof of speeding, however, if you are new to the area or if they think they can get away with it, they will ticket you. You have the right of appeal to the Circuit Court of Kanawha County and if you appeal the charge will most likely be dropped before the appeal process is completed, but the Circuit Court will dismiss the charge if it goes that far. Deputy Sheriffs and State Police can enforce the speed laws in Clendenin, however, it is rare that they do.

Comment (3/2005): 18 different people have just filed lawsuit against the Town of Clendenin because of a conspiracy to coerce guilty pleas to traffic offenses, some of which don't even exit.

Comment (10/2003): The City Police are issuing tickets for any infraction of the law, no matter how minor. Make sure your license plates do not have mud on them or that your license plate light is out. Radar use has started up again even though it is illegal for a town of less than 2,000 population to use radar. The police count on the fact that most people won't contest the tickets or feel to intimidated to contest the ticket.

Comment (10/2007): Don\'t fall for what you have read. It is not illegal to run radar in a class IV town in the State of West Virginia, the officer just cannot use the radar only as proof. Any officer properly trained to use radar knows the proper procedures also. Clendenin is not a speed trap. Speed limits are reduced on 119 due to two intersections. The state did that, not the town.

The Town of Clendenin is a Class IV town and by WV law cannot use radar thus the local PD has devised a charge of "too fast for road conditions". This charge in reality is a "contributing factor" in accidents, however, the PD doesn't care about that and issues these citation regardless of what the weather and where no accident has occurred. Ask for a hearing and you get slapped with an exhorbant high cash only bond or go to jail. To get out of the situation, you then must plead guilty and waive your right to counsel.
